By creating an account, making a booking, accessing recordings, or otherwise using the PaperclipSA platform, you agree to be bound by these Terms and Conditions.
2. Definitions
- PaperclipSA means PaperclipSA.
- User means any person who accesses or uses the platform.
- Recording means any video, image, clip or other content captured through the platform.
- Venue means any sports facility where the system is installed.
3. Nature of the Service
PaperclipSA provides technology and services that facilitate the recording and distribution of sporting activities.
Recordings are provided on a best-effort basis and are not guaranteed.
4. Relationship with Venues and Participants
PaperclipSA is not the organiser, operator or manager of sporting activities and is not responsible for venue operations or participant conduct.
5. User Accounts
- Maintain confidentiality of login credentials.
- Ensure information is accurate and up to date.
- Accept responsibility for account activity.
6. Recordings and Participant Consent
Users acknowledge that sporting activities may be recorded.
The person making a booking is responsible for ensuring participants are aware that recording may take place.
7. Access to Recordings
PaperclipSA may determine how recordings are delivered, how long they remain available and the format in which they are provided.
8. Intellectual Property
All rights in the platform, software, branding and website content remain the property of PaperclipSA or its licensors.
9. Acceptable Use
- No unlawful use.
- No interference with the platform.
- No unauthorised access attempts.
- No malicious software uploads.
- No impersonation.
10. Limitation of Liability
Services are provided on an "as is" and "as available" basis.
PaperclipSA shall not be liable for failures to record activities, lost recordings, service interruptions or delays.
11. Indemnity
Users agree to indemnify and hold harmless PaperclipSA, its directors, employees, contractors and agents from claims arising from use of the platform.
12. Privacy
Personal information is processed in accordance with the Privacy Policy.
13. Changes to the Service
PaperclipSA may modify, suspend or discontinue services without prior notice where reasonably necessary.
14. Changes to these Terms
Updated versions will be published on the website and become effective upon publication.
15. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
